5. All products sold through the website www.fashion-luna.com possess the properties necessary for the regular use of that kind of goods in accordance with its purpose, which is defined in the Declaration of each individual product, in accordance with all relevant laws of the Republic of Serbia.

6. The conformity of the goods to the contract shall be determined exclusively by the properties and purpose of the goods as defined by the respective declarations of each individual product.

7. The selling price of the goods is indicated with each item in the manner prescribed by the laws of the Republic of Serbia.

8. All products that have special properties or defects, as well as products that are on special discounts or promotions will be clearly marked with the indicated price of each individual product as prescribed by the laws of the Republic of Serbia. Periods of promotional and / or special deal discounts will be adequately indicated.

9. Photographs of the products are only illustrative in nature, so they do not always have to correspond to the actual products in all details. Due to the possibility to individually adjust the monitor or display on a mobile device, we cannot guarantee the full colour equivalence of our colour products as seen by users (consumers) on the screen of your monitor or mobile device. Please note that in such cases, the complaint is not justified.

17. Purchases with special price benefits and / or special sales incentives (giveaways, stock sales and similar) are made in accordance with the terms and conditions published on the website www.fashion-luna.com.

18. The service of delivery of goods is defined here and is free for all orders on the territory of the Republic of Serbia, while for the rest of the world it is defined here. If you decide to purchase via POSTEXPORT when purchasing and shipping outside the territory of the Republic of Serbia, all deliveries for a product value of more than 50 Euros are free of charge. If you have opted for DHL courier service for all deliveries for a product value of more than 300 Euros when purchasing and shipping outside the territory of the Republic of Serbia, it is free of charge. The exceptions to this rule are: special distant areas whose list can be downloaded here, countries of increased risk, whose list can be downloaded here and the areas / countries under UN sanctions, whose list can be downloaded here.

19. Products that are delivered to countries outside the territory of the Republic of Serbia are invoiced with value added tax (VAT). In addition to the cost of the desired products, the invoice also contains the amount of transport costs if the purchase is subject to payment of transportation costs. Please bear in mind that you are obliged to pay the cost of customs and value added tax on purchased products and any additional related costs incurred in accordance with local regulations.

20. Purchased goods are delivered on the territory of the Republic of Serbia through courier service Daily Express, in the manner defined here. For all territories outside the borders of the Republic of Serbia, we make deliveries through the DHL courier service or POSTEXPORT, as defined here.

21. You can pay the products purchased via the online store www.fashion-luna.com by cash at the time of delivery or payment cards for purchase and delivery on the territory of the Republic of Serbia. If you want to buy a product that will be shipped in the territory outside the borders of the Republic of Serbia, payment is only by defined payment cards at the time of purchase on the site. 22. You have the right to terminate the distance contract at any time before or after receiving the goods. You can get acquainted with your rights guaranteed by law here. The procedure is defined here, you just need to submit a form that you can download here.

23. If you do not wish to retain the product after receiving it, you are entitled to withdraw from the contract in the manner defined here. In the event of the withdrawal from the contract, you are entitled to a refund in accordance with the refund procedure you can download here. We ask our valued customers to bear in mind that if they purchased a product that will be shipped outside the territory of the Republic of Serbia the additional costs they may have incurred (transportation, customs, taxes, bank fees, etc.) are not refundable in case of cancellation of purchase / returns of purchased products.

24. If you find that the size is not appropriate when receiving the ordered products, you have the option to replace the product for another in the appropriate size within 14 days, as defined here.

25. If, after receiving the goods ordered, you want to replace the item for another article, which may be of higher, lower or same price categories as the previously ordered item, you can replace it within 14 days as defined here.

26. For all products that you have purchased through the website www.fashion-luna.com, you have the right to file a complaint, claim or objection in accordance with the Consumer Protection Act. Here you can download a document that defines your legally guaranteed rights. The procedure for their resolving is conducted on the basis of the provisions of the abovementioned law, as well as the provisions of the Law on Trade ("Official Gazette of RS" No. 53/10, 10/2013), in a way that is defined for goods purchased through an online store. 27. When you need to file a complaint, claim or objection, you must send us a completed form that you can download here.

28. In the event that we are unable to replace the item for which we accepted the complaint with the appropriate one, the other item, the Luna fashion house is obliged to make a refund to you. You can check the refund procedure here.

29. Items purchased in our online store may not be returned to our retail stores, but only through the procedure described in the Complaint Procedure and the Right to Withdrawal part.

33. In the event that one of the defined cases of force majeure occurs, all our previously undertaken obligations shall be delayed for a certain period of time. All contracts accepted by that moment or at the time of the appearance of the event of force majeure shall be partially or completely terminated by one of the participants (you or Luna). The force majeure includes a state of war, unrest, civil war, revolution, emergency or special state of functioning of the state, strike or general strike of key infrastructure institutions, suspension of the delivery of electricity-telephone-Internet services, natural disasters, etc. In the event of such special conditions of life and work, Luna will do everything in its power to resolve all current orders, situations in the fastest possible way.

COMPLAINTS

Luna Fashion House dedicates great attention to the quality of its products. If it happens that you still have some complaint, we are there to solve it in the most efficient way.

Note: The product photos are just illustrative, so they do not always have to match actual products in all details. Due to the ability to individually adjust the monitor or display on a mobile device, we cannot guarantee the full colour equivalence of our colour products, as you see them as our user on the screen of your monitor or mobile device. Please note that in such cases, the complaint is not justified.

 

Complaint Procedure

If you have a complaint, a reclamation, an objection or want to make a return of the purchased item, the procedure is simple:

1. Please fill out the form. You can download it here.

2. Fill in the form and submit it to the email address webshop@fashion-luna.com. Please attach the scan / photocopy of the invoice / delivery note provided with the product. If the product you purchased has a defect / damage or is non-compliant, please submit photos that illustrate it attached to the form, in order to quickly and efficiently resolve the complaint process. Please understand that in some cases some additional information, scan of a document or photos may be required.

3. You will receive a receipt from us with the number under which it is registered in our registry. This is the number to track the status of your complaint.

4. Your complaints will be processed as soon as possible, and we will notify you of the decision on your complaint in writing.

5. Please give statement in writing to our proposal for a reclamation solution. Upon receipt of the statement, the operator will inform you of the remaining steps for the successful realization of the complaint.

6. After you return the item to which we are filing a complaint, we will send you either a repaired item or new item or replacement item for which you have opted or the correct size if you have received, by a mistake, another size or in the event that the article is no longer available and you do not want delivery of another item from our product range, you will be refunded.

When preparing an item for return, please pack it properly in the original packaging in which you received it, so that there will be no damage in the transport.

Please do not attempt to personally leave or exchange your item in any of the Luna retail stores.

Returning personally to any of the Luna retail stores is possible only and exclusively if you want to replace your item for the same model in other size.

Conditions for Filing a Complaint, Claim or Objection

You have the right to complaint, claim or objection in the following cases:

1. If you received the shipment and after opening the box, you find out that the delivered goods do not correspond to the ordered, either by type, quantity or size.

2. In case the accompanying documentation (invoice) is not appropriate in any segment.

3. If it is clearly visible on the product that it has a damage / defect, and that the defect was not incurred by improper use, i.e. the handling in accordance with the stated in the accompanying declaration, but that there has been a manufacturing, packaging or transport irregularity.

4. In the event of non-conformity within the meaning of Article 52 of the Consumer Protection Act, and as a buyer, you handled the goods in accordance with the rules defined in the declaration of each individual product.

PAYMENT METHODS

We have provided you with simple and efficient payment models for all your purchases on the online site of the fashion house Luna:
1. Payment by payment cards during the purchase process on the site
2. Payment by cash at the delivery, exclusively for purchase and delivery on the territory of the Republic of Serbia.

You can pay your order using Visa, Mastercard, Maestro, American Express cards, whether you make purchases on the territory or outside the territory of the Republic of Serbia. The card must be approved by the issuing bank for online (Internet) payment. Your credit card information is not available to our system at any time.

Payment by cards

By choosing the appropriate payment method (one-off or payment on instalments) you will be redirected to the page of the Intesa bank that is protected and safe for this type of payment.

When entering payment card information, confidential information is transmitted through a public network in a protected (encrypted) form using the SSL protocol and PKI system, as the currently most advanced cryptographic technology. The security of the data during the purchase is guaranteed by the payment card processor, Banca Intesa ad Belgrade, so the complete charging process is carried out on the bank's pages. Payment card information is not available to our system.

* Data entry and checking is performed exclusively between the card user and the Intesa bank, and the Internet seller does not have access to the data exchanged.

Payment is possible with payment cards of domestic and foreign banks.

Payment to residents of the Republic of Serbia is allowed only in RSD currency.

In the event of non-compliance with the rules, the buyer shall bear criminal and material liability.

Only the payment card owner can make a payment.

In the case of a refund, when you pay the goods with one of the payment cards, we oblige that we will refund the funds only through the payment card with which you made the payment (VISA, EC / MC, Maestro and other electronic payment methods) or by payment to your current account. At the request of the seller, the Bank will make a refund only to the account of the card user from which the item was paid.

In no any case, under no circumstances you may require cash refund for a transaction made using a payment card.

 

Payment in cash on delivery

If you want to buy a product in our online store, and the delivery should be on the territory of the Republic of Serbia, you will have the option of paying by cash at the time of delivery by courier service.

In the case of a refund when you pay the goods in cash, we undertake to make a refund only through a payment card (VISA, EC / MC, Maestro and other electronic payment methods) or by paying to your current account. You may not in any way, under no conditions, request a refund of cash for a cash transaction.

WSPay ensures the buyer and the merchant with the secure card data entry and transfer, which is also confirmed by PCI DSS certificate. WSPay uses 256-bit SSL encryption and TLS 1.2 cryptographic protocol as the highest protection standards for data entry and transfer.

 

1. Territory of the Republic of Serbia

You can pay for the products of Luna Fashion House for delivery on the territory of the Republic of Serbia by payment cards or cash on delivery through courier service Daily Express.

We send the ordered products to you within 3-5 working days from the receipt of the order confirmation.

If you choose a payment method by cash on delivery, you will make the payment to the courier service upon delivery of the shipment. Please prepare the exact amount of the payment.

In the event that you choose payment by payment cards, you will have the option of choosing, during payment process, between payment by payment cards or payment by payment cards at 6 monthly instalments. Depending on the option selected, you will be able to purchase a product by purchasing for the whole amount of your purchase in the process that you will follow step by step after clicking the "pay" button. Alternatively, you can make a purchase by choosing a payment option at instalments during which you will select the desired number of instalments in the appropriate field for which you want to share the total amount of purchase.

Payment of all orders in the Republic of Serbia is done in dinars (RSD).

 

2. Worldwide, except the territory of the Republic of Serbia

You can pay the products of the Luna Fashion House for delivery outside the territory of the Republic of Serbia only with payment cards during the purchase process on the website, in the manner described by the payment card procedure.
If the user opts for payment by foreign issuer's payment cards, the amount of the transaction in dinars (if you have chosen for the prices expressed in dinars) will be converted into the settlement currency of the Bank (EUR) according to the exchange rate of the National Bank of Serbia. When debiting your payment card, the already converted amount from dinar to euro will be converted to your local currency, according to the rate applied by the payment card operators. The price listed on the website in dinars is fixed, however, due to these conversions it may be possible to deviate from it when you translate it into local currency of issuers of bank cards or when you compare the euro price on our site with the price in euro that was applied in the billing or conversion process of euro into dinars.

Payment of all orders that are delivered outside the territory of the Republic of Serbia is done in euro or by conversion of the euro into the local currency that is valid in the country of delivery. The invoice you pay will include the shipping cost to the desired country / delivery location. In the case where the place of delivery of the products outside the territory of the Republic of Serbia is selected, the price of the desired products will automatically be presented in the EUR currency. In this case, your payment card will be debited by the amount of the euro indicated on the invoice for the desired transaction or in the local currency converted from the amount of the euro shown on the invoice. The price listed on the site in euro is fixed, however, due to conversion, it is possible that there is a deviation from it when you translate it into local currency of issuers of bank cards or when you compare the euro price on our site with the price in euro that was applied in the billing process ie conversion of the euro in the local currency.

2. In the window that opens, enter all the information requested.
3. After entering the data, you have a box with a link to the Set of Documents which contains the Terms of Use and operating rules of our site, as well as all your rights arising from the legal regulations of the Republic of Serbia. Please confirm in the box provided for that you have read them and that you agree with them.
4. Confirm the information entered by clicking the "Registration" button.
5. After confirming the entry of the data with the "Registration" button, a new window will appear with the notification of the successful start of the registration process. After that, you will receive an automated message to your email that you have successfully completed the registration process at www.fashion-luna.com. Please check the mailbox for your email address in order to verify that you have entered the correct email address when registering.
6. The mail that we sent you as an automatic message is in the Inbox folder of your mailbox. If not, please check if it is accidentally in the "Spam" or "Junk" folder. DELIVERY CONDITIONS

After confirming the desired order on the website of Luna Fashion House, you will receive an email confirming that your order has been received. The email will show the shipping information you left on the registration (name and surname, address, contact phone), list of ordered items, individual prices and total price.
 

1. Delivery Deadline

Republic of Serbia

Delivery time is 5-10 business days for the territory of the Republic of Serbia and starts to run from the first following business day after the order is sent. The cost of delivery in the territory of the Republic of Serbia is borne by the Luna Fashion House. In the event of a delay in delivery, our operator will notify you of the same. After sending the shipment, we will send you an email with your order code based on which you can monitor the status thereof and newly projected delivery time on the Daily Express website.

Your order for the territory of the Republic of Serbia will be delivered by courier service Daily Express from 8-16 h every working day to the address you left when ordering. During this period, please ensure that there is a person who can take over the item at the address. The courier is obliged to try to deliver each item on two occasions. The usual practice of Daily Express is that if a courier does not find you at the address, he/she will try to call you on the phone that you left when creating a purchase order and arrange a new convenient delivery date. If they do not find you at the address for the second time after arranging the delivery term, the shipment will return to us. Upon receipt of the shipment, we will contact you by phone to determine which is the reason for the non-delivery of the shipment and when it is appropriate for you to resend it.

All your orders made during the weekend and holidays will be processed on the first next working day.

Rest of the World

For territories outside the Republic of Serbia, the delivery deadline is in accordance with the delivery deadlines defined by the courier services DHL and POSTEXPORT. Delivery time depends on the chosen courier service and the zone in which the delivery country is located and ranges from 7 to 15 days (for Europe 7-10 days, for the rest of the world 10-30 days). Here you can download the Tables of Zones and Delivery Deadlines. Please note that if you choose POSTEXPORT it will take several days longer than DHL express courier service, probably 5-10 days more depending on the country of delivery. Delivery deadlines are also dependent on specific local legal regulations, including the terms of work of customs services, and the acting procedures thereof, which can be reflected in the delivery times indicated above. In the planning of your orders, you also have to consider any unforeseen circumstances that may occur that may affect the projected delivery deadlines and it is not up to Luna Fashion House.

Your order will be delivered during the working day (Monday-Friday), from 8 to 17, all in accordance with the working time of the local DHL branches in the country of delivery, ie the delivery deadlines of the local postal services with which POSTEXPORT has a contract about cooperation.

 

2. Delivery Mode

When picking up the goods, please visually inspect the package to see that it does not have any visible damage. If you have chosen to transport your product by DHL and on visual inspection notice that there are any defects that you suspect may have affected the quality of the delivered product, please refuse to receive the shipment. If you chose to transport by POSTEXPORT and on visual inspection notice that there are any defects that you suspect may have affected the quality of the delivered product, please receive the package and photograph the package you received. If, after opening the package and reviewing the products you have purchased, you find that the products are damaged during transport, please also take a photo of it and send all these photos with the complaint form to our operator at webshop@fashion-luna.com.
You should notify us immediately of any problems you have encountered by emailing us at webshop@fashion-luna.com so that we may be more efficient in future deliveries.

If the visual inspection of the shipment shows that it is free of damage, you can sign the shipment and take it over freely.

If you decide to purchase via POSTEXPORT when purchasing and shipping outside the territory of the Republic of Serbia, all deliveries for a product value of more than 100 Euros are free of charge. If you choose this transport option, you have no additional transportation costs regardless of the country and / or location within the country.
If you have opted for DHL courier service for all deliveries for a product value of more than 300 Euros when purchasing and shipping outside the territory of the Republic of Serbia, it is free of charge. Please note that specific countries and / or areas within specific countries defined as "remote areas" have special delivery conditions for DHL courier services with additional delivery costs. You can download the cost of delivery for these special areas here.

If the country of delivery is in an increased risk area, the cost of delivery is subject to a surcharge for increased risk. You can download the increased risk costs table here. The countries for which this surcharge is charged are: Afghanistan, Iraq, Libya, Mali, Niger, South Sudan, Yemen, Syria.

In case the country of delivery is located in the zone under UN sanctions, the cost of delivery is subject to an additional surcharge. You can download the surcharge costs table here. The countries where this surcharge is charged are Iran (Islamic Republic of), Iraq, Libya, Sudan, Yemen, Central African Republic, Democratic Republic of the Congo, Eritrea, North Korea, Somalia, Syria.

In the event that, due to objective circumstances, we are not able to provide delivery of ordered items, our operator will notify you as soon as possible and offer you some of the possible alternative solutions.

REFUND

Refund Procedure

The procedure for refunding of funds is simple and consists of several steps:

1. Please send us a filled-in refund form that you can download here and attach the necessary documentation to the email address webshop@fashion-luna.com.
2. The online store operator will send you a confirmation of the validity of the information provided as well as a product return instruction.
3. Pack the product you intend to return carefully to ensure that no damage occurs in the transport. It is required to attach the invoice / dispatch note. The refund is made in accordance with the instructions you received from our operator, and depends on the basis for the refund.
4. We will refund funds in the shortest possible time, after receiving the product and verifying its proper status.
5. If you want to withdraw from the distance contract before delivery of the product, the money will be returned to you as soon as possible to the account from which you made the payment. Also, when we are unable to deliver the desired paid product, and you do not want other from our range, the money will be returned to you as soon as possible.

Without the prior agreement with operators in the online store, the delivered item cannot be sent directly, on one own’s accord, to the address from the invoice / delivery note or from this site. Any such package will be returned to the sender about his expense. Please do not leave items personally in any of the Luna retail stores in order to obtain the return of funds as this cannot be done.

 

Method and Cost of Refund

In the case of a refund for products that you have paid with one of the payment cards, we undertake to make the refund only through the payment card with which you made the payment (VISA, EC / MC, Maestro and other electronic payment methods). At the request of the seller, the bank will make a refund only to the account of the card user from which the item is paid. If you have paid your products with cash at takeover, we commit to paying your money either to your current account or to a payment card. Please keep in mind that in no case, under no circumstances, you can claim a refund in cash for a transaction made using a payment card, or for payments made in cash. The amount of money that you paid under a distance contract will be returned to you as soon as possible, without delay (at the latest within 14 days from the date of receipt of the statement of withdrawal and product). The costs of returning of goods and money shall be borne by the buyer in the event of a withdrawal from the distance contract or substitution of item for another item or another size of the same item. In case of non-conformity of the item, the delivery of the wrong item or item with the defect, the cost of transport of goods and money is borne by the Fashion House Luna.

Dear customers, we inform you that in accordance with the Law on Consumer Protection ("Official Gazette of RS" No.62 / 2014, 6/2016-st. law I 44/2018- st. law), purchase through our website (our online shops) www.fashion-luna.com is considered to be distance sales. If you want to give up the purchase, the procedure is simple:

1. Send us to our e-mail address webshop@fashion-luna.com a statement of the cancellation of the distance contract. The deadline for sending a statement is 14 days from the moment of the conclusion of the contract between the consumer and the trader.

2. We will acknowledge receipt of the statement and the number under which it is registered. Our operator will provide you with an address where you need to return the purchased product.

3. You must return the product no later than 14 days from the date you submitted the withdrawal form.

4. Upon receipt of the product and professional verification of its suitability, the money paid will be returned to you as soon as possible within 14 days at the latest.

5. If you withdraw from the contract before the delivery of the goods, the paid money will be returned to you as soon as possible and at the latest in 14 days.
